Abstract
Background. Over the past decade Chinese law has witnessed many changes regarding the protection of personal rights and personal information. The active technological development and changing social relations necessitate the study of foreign practices in this field. The aim of the study is to highlight the features of the legal protection of personal information in the People's Republic of China in terms of achieving a balance between private and public interests. Materials and methods. The tasks of the study are fulfilled through examining the research articles by Russian and Chinese experts devoted to the protection of the right to privacy. Special attention is given to the regulatory legal acts of the People's Republic of China. The methodological potential includes the method of analysis and the comparative legal method that allow exploring certain norms of Chinese legislation and finding opportunities to improve Russian legislation. Results. The norms of the new Civil Code of the People's Republic of China on the protection of personal information and the Law on the Protection of Personal Data in the People's Republic of China are analysed. The article considers the changes in criminal legislation in this field. The researcher examines the features of ensuring the protection of personal data processed using modern technologies. Conclusions. Studying the features of regulatory legal acts on the protection of personal information in the People's Republic of China enables identifying the current trends in the development of legislation, namely searching for a balance between per-sonal, public and state interests, tightening the requirements and penalties in this field, enforcing new rights (right to voice, right to portrait) that require protection, developing the security standards for personal data processed using modern technologies. An analysis of the benefits and challenges of these regulatory legal acts will help to formulate the proposals for improving the Russian legal system.
